Terms & Conditions

 

  • Term and Duration

          1.1: Kiwi PC non-members Agreement shall take effect from the time the technician
          arrives till the technician leaves the premises, with a minimum of one hour charge.
          1.2: Kiwi PC members Agreement shall take effect from the KiwiCare plan
          commencement date as agreed upon by Kiwi PC and the client;  and continues for an
          initial term of not less than one (1) year. Thereafter it shall be automatically renewed for
          successive terms of one (1) year each until terminated in accordance with the following
          clause :
               1.2.1: Upon the expiration of the initial term for Kiwi PC members , members may
               terminate service within thirty (30) days by contacting Kiwi PC.
          1.3: Terminating the contract before the end of the agreed term will incur a $49.99
          charge.

 

  • Charges

          2.1: Non–Member clients shall pay to Kiwi PC the basic charges set out, paid in the
          manner directed by Kiwi PC.
          2.2: Member Clients shall pay to Kiwi PC the monthly membership charges set out in the
          KiwiCare plan chosen. Such charges shall be paid in the manner directed by Kiwi PC.
          KiwiCare plan charges are in advance at monthly intervals. Incurred service charges are
          payable to Kiwi PC upon completion of the service appointment.
          2.3: KiwiCare plan charges are separate from Kiwi PC’s hourly service charges.
          KiwiCare plan charges ONLY entitle Kiwi PC clients to the discounted Kiwi PC service
          charges in accordance with the specific plan agreed upon and its related priority services.
          2.4: KiwiCare plan charges will commence on the chargeable commencement date as
          indicated.
          2.5: Kiwi PC reserves the right to make a 2% late payment charge on overdue accounts
          and shall be entitled to suspend this Agreement or charge basic non-member charges until
          full payment of all sums overdue.

 

  • Service Responsibilities

          3.1: Kiwi PC will at the Client's site and offsite where applicable maintain the equipment
          in good operating condition.
          3.2: If in Kiwi PC’s reasonable opinion, equipment cannot be properly or economically
          repaired due to obsolescence, excess wear or deterioration, Kiwi PC will advise and
          discuss the replacement of equipment at the clients cost.
          3.3: Kiwi PC shall provide the contracted service during normal working hours or the
          hours specified in the KiwiCare plans but the Client may request service outside of those
          hours and Kiwi PC will make every effort to accommodate this request.

 

  • Client's Responsibilities

          4.1: The Client shall allow Kiwi PC full and free access to the equipment and provide
          Kiwi PC with all reasonable facilities on site to service the equipment.
          4.2: For on-site services, a person at least 18 years of age must be present at the
          premises during the entire time period for which services are provided. If no adult is
          present when the Kiwi PC technician arrives, services will be denied and a $20 charge
          will be incurred.
          4.3: The Client shall maintain the environment in a clean tidy manner.
          4.4: The Client shall ensure that Kiwi PC confidential information and trade secrets shall
          not be published or transmitted to third parties either during or after the term of this
          contract.
          4.5: The client shall ensure that any important data had been backed up or advise Kiwi
          PC technicians that a backup needs to be performed.
          4.6: Cancellation of any appointment must be advised to Kiwi PC no later than 6 pm on
          the working day prior to the day of the appointment or a $20 cancellation fee will be
          assessed.

 

  • Privacy

          5.1: Kiwi PC will maintain the confidentiality of the Customer's files and/or data and
          undertakes not to  provide any Customer information to any third party unless in the event
          it is lawfully required to do so.

 

  • Payment Terms and Conditions

          6.1: KiwiCare plan memberships cover 12 months with a minimum 1 year contract
          required. Monthly payments are in advance at monthly intervals.
          6.2: The client will be liable to all costs, charges and expenses incurred by us in
          recovering debt from the client’s overdue account.

 

  • Limitation of Liability

          7.1: Kiwi PC shall not be liable for indirect or consequential loss including but not limited
          to loss of use, data, profits, business, revenue, goodwill or anticipated savings because of
          failure of equipment being maintained by Kiwi PC.
          7.2: Kiwi PC has no liability for Customer data lost or damaged. It is the responsibility of
          the client to advise us whether data has been backed up or not.
          7.3: Kiwi PC shall not be liable to damage caused as a result of:
          (a) Fire, storm, earthquake or act of God; or
          (b) Unauthorized attempts by other than Kiwi PC personnel to repair the equipment
          (c) Causes other than normal wear and tear including failure of equipment not maintained
                by Kiwi PC or its agents or non-Kiwi PC supplied consumable items, negligence of 
                or misuse of the equipment;
          Or
          (d) Causes external to the equipment such as transportation.

 

  • Satisfaction policy

          8.1: No Fix No Fee.
          8.2: All work is guaranteed for 10 days. All new goods sold by us are covered by a
          warranty of 12 months, or that required applicable by law. If a fault does develop or is
          found within the warranty period, this must be notified to us directly so we can remedy
          the problem at no extra charge.
